Spotsylvania Co. Public / Private Partnership
On behalf of his then client, Spotsylvania County Infrastructure, LLC (SCI), a special purpose Virginia entity created by Shirley Contracting Company (a division of Clark Construction Group) and W.C. English, Inc., Tom Byrnes engaged with Spotsylvania County elected officials and county administration leaders to help create the municipality’s first ever public-private partnership.
Tom was engaged to get the county’s elected officials behind the initiative and to ensure they 1) successfully adopted the Virginia Public Private Transportation Act (PPTA) guidelines required of Virginia jurisdictions pursuing public-private solutions for major capital improvement projects, and 2) to ensure the board of supervisors voted to accept their solicited PPTA proposal of nine road improvement projects in the amount of nearly $90 million, following a $144 million voter-approved bond referendum for public infrastructure improvements and education that passed (with strategy consultation from Tom) in 2005.
Dewberry served as the lead design engineer for SCI, and the team developed over 40 alternatives for the nine projects.
Tom represented SCI throughout the guidelines initiative, the solicited PPTA submission and subsequent votes to approve both. In November of 2007, the county entered into a comprehensive agreement with SCI to complete the design and construction of all nine projects. SCI received the notice to proceed in 2009, and the success served as a catalyst for neighboring jurisdictions to establish their own public-private partnerships.
